Terms of Service

Welcome to amingo. These Terms of Service ("Terms") govern your use of amingo's mobile application, website, and services (the "Service"). By registering or using amingo, you agree to these Terms.
If you do not agree, do not use amingo.
1. Eligibility and Age Requirements
1.1 Minimum Age
You must be at least 17 years old to use amingo. By registering, you confirm you meet this requirement.
Users under 13: We do not knowingly permit anyone under 13 to use amingo. If we discover an account belongs to a user under 13, we will immediately terminate the account and delete all associated data within 30 days.
Users 13–16: Must have verifiable parental or guardian consent. If you are between 13 and 16, a parent or guardian must accept these Terms on your behalf before you use the Service.
1.2 Legal Capacity
You must have the legal capacity to enter a binding contract. If using amingo on behalf of a company or organization, you confirm you have authority to bind that entity to these Terms.
2. Your Account
- Provide accurate, current, and complete registration information
- Keep your password secure; do not share it with others
- Maintain only one account per person; duplicate accounts used to evade enforcement are prohibited
- Notify us immediately of unauthorized use: support@amingo.app
- You are responsible for all activity under your account
3. Your Mini Me — AI Twin Feature
3.1 What Is Mini Me
Mini Me is an AI persona trained on personality data, interests, and (optionally) a voice recording that you provide. Mini Me interacts on your behalf through automated chat, comments, and social actions.
3.2 Your Responsibility for Mini Me
You are solely and fully responsible for:
- All data and instructions you use to configure your Mini Me
- All interactions, statements, and content your Mini Me generates on your behalf
- Ensuring your Mini Me complies with these Terms and all applicable laws
amingo is not liable for statements, interactions, or content generated by your Mini Me. AI outputs may not accurately reflect your actual views. You should review your Mini Me's interactions regularly.
3.3 Prohibited Mini Me Configurations
You may NOT configure or use your Mini Me to:
- Impersonate others: Create a Mini Me trained to sound like, behave as, or represent any real, identifiable person other than yourself
- Voice fraud: Use any voice clone feature to impersonate another person, circumvent biometric authentication on any system, facilitate phone or voice scams, or produce voice phishing content
- Fraudulent claims: Represent your Mini Me as a licensed professional, doctor, lawyer, financial advisor, or any role requiring credentials you do not hold
- Commercial solicitation: Conduct multi-level marketing, pyramid schemes, or unsolicited commercial outreach
- Harmful deception: Deliberately configure Mini Me to deceive other users in ways that cause harm, including romantic scams or catfishing for financial gain
3.4 Ownership of Mini Me Data
- Your personality data and voice recording remain yours
- The AI model and voice synthesis engine generated by amingo from your data are owned by amingo, licensed to you for personal use within the Service
- Upon account deletion, both your source data and your personal Mini Me model are deleted
4. Content Rules
4.1 Your License to amingo
You retain ownership of content you create ("User Content"). By submitting User Content, you grant amingo a non-exclusive, worldwide, royalty-free, sublicensable license to store, display, reproduce, and distribute your content solely to operate and improve the Service. This license ends when you delete your content or account.
4.2 Prohibited Content
You and your Mini Me may NOT post or generate content that:
- Harasses, bullies, threatens, or intimidates any person
- Constitutes hate speech based on race, ethnicity, religion, gender, sexual orientation, disability, or national origin
- Contains explicit sexual content; any sexual content involving minors will be immediately reported to NCMEC and law enforcement
- Depicts or encourages real-world violence, self-harm, or suicide
- Doxxes, exposes, or threatens to expose private information about others
- Constitutes spam, fake engagement, or coordinated inauthentic behavior
- Infringes copyright, trademark, or other intellectual property rights
- Violates any applicable law
- Spreads knowingly false information likely to cause real-world harm
4.3 Reporting and Moderation
We provide in-app tools to report any content or account that violates these rules. We review all reports and take action, which may include content removal, account suspension, or reporting to law enforcement. For urgent safety issues: safety@amingo.app
4a. Community Guidelines
Our Community Guidelines (available at https://amingo.app/community-guidelines) are incorporated into these Terms. Violation of the Community Guidelines is a violation of these Terms and may result in content removal or account termination.
4b. Crisis and Emergency Situations
If amingo becomes aware of a credible, imminent threat to the life of a user or others (whether through direct messages, Mini Me interactions, or reports from other users), we may:
- Provide in-app crisis resources and helplines
- Contact relevant emergency services, overriding normal privacy protections to the extent permitted by law
This does not create an obligation on amingo to monitor all content, nor does it make amingo liable for failing to detect or respond to every crisis situation.
5. Copyright and DMCA Notice & Takedown Procedure
amingo respects intellectual property rights. We comply with the Digital Millennium Copyright Act (17 U.S.C. § 512) and respond to valid copyright infringement notices.

5.2 To Submit a DMCA Notice
Your notice must include:
- Your physical or electronic signature
- Identification of the copyrighted work you claim has been infringed
- Identification of the infringing content and its location within amingo
- Your contact information (address, phone, email)
- A statement that you have a good-faith belief the use is unauthorized
- A statement under penalty of perjury that the above is accurate and you are the rights owner or authorized to act on their behalf
5.3 Counter-Notice
If your content was removed and you believe it was a mistake, you may submit a counter-notice to dmca@amingo.app. Counter-notices must comply with 17 U.S.C. § 512(g)(3).
5.4 Repeat Infringers
We will terminate the accounts of users who are determined to be repeat infringers.
6. Acceptable Use
You may NOT:
- Reverse engineer, decompile, or attempt to extract amingo's source code or AI models
- Scrape, crawl, or use automated tools to access amingo beyond your personal Mini Me as designed
- Attempt unauthorized access to other users' accounts or amingo's systems
- Interfere with or disrupt the Service's performance or infrastructure
- Use amingo for commercial purposes (advertising, solicitation, resale) without prior written consent
- Engage in any activity that violates applicable local, state, national, or international law
7. In-App Purchases and Apple / Google Billing
7.1 iOS (Apple App Store)
Any purchases made through the iOS version of amingo are processed by Apple through the App Store. Apple's payment terms apply. For refund requests on iOS purchases, contact Apple directly at https://reportaproblem.apple.com. amingo does not have access to your payment information for App Store transactions.
7.2 Android (Google Play)
Any purchases made through the Android version are processed by Google Play. Google's payment terms apply.
7.3 No External Payment on Mobile
amingo will not require or solicit iOS users to make payments outside the App Store for features available within the iOS app. Any paid features must be purchased through the appropriate platform billing system.
8. Account Suspension and Termination
We may suspend or terminate your account, with or without notice, if you violate these Terms or if your account poses a risk to other users.
Your right to delete: Settings → Account → Delete Account. All data will be permanently deleted within 30 days. Some data may be retained longer as required by law.
Upon termination, your license to use amingo ends immediately. Sections that by nature survive termination (intellectual property, DMCA, indemnification, disclaimers, limitation of liability) will survive.
9. Intellectual Property
All rights in amingo — including the app, website, AI technology, Mini Me engine, voice synthesis engine, brand, and design — are owned by amingo or its licensors. These Terms grant you only the limited right to use the Service as described; no other IP rights are transferred.
10. Privacy
Our Privacy Policy (https://amingo.app/privacy) is incorporated into these Terms by reference.
11. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." AMINGO MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
AI-GENERATED CONTENT: MINI ME RESPONSES ARE GENERATED BY AI. AMINGO DOES NOT WARRANT THEIR ACCURACY, COMPLETENESS, OR FITNESS FOR ANY PURPOSE. MINI ME OUTPUTS DO NOT CONSTITUTE PROFESSIONAL ADVICE OF ANY KIND.
AVAILABILITY: We do not guarantee the Service will be uninterrupted or error-free.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AMINGO AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL.
AMINGO'S TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE GREATER OF: (A) AMOUNTS YOU PAID TO AMINGO IN THE 12 MONTHS PRECEDING THE CLAIM; OR (B) USD $100.
13. Indemnification
You agree to indemnify and hold amingo and its affiliates, officers, directors, employees, and agents harmless from any claims, losses, liabilities, and expenses (including attorney's fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your User Content or your Mini Me's interactions
- Your violation of any third party's rights, including intellectual property or privacy rights
14. Dispute Resolution and Arbitration
14.1 Governing Law
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles. This Agreement is also governed by the Federal Arbitration Act (FAA) to the fullest extent permitted by law.
14.2 Informal Resolution First
Before initiating arbitration, you must first contact us at legal@amingo.app and describe your dispute in detail. We will attempt to resolve it informally within 30 days.
14.3 Binding Arbitration
If informal resolution fails, disputes shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration will be conducted via video conference.
14.4 Class Action Waiver
YOU AND AMINGO AGREE THAT EACH MAY BRING CLAIMS ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE ACTION. The arbitrator may not consolidate more than one person's claims.
14.5 Opt-Out Right — 30 Days
You may opt out of the arbitration agreement by sending written notice to legal@amingo.app with the subject line "Arbitration Opt-Out" within 30 days of first accepting these Terms. If you opt out, disputes will be resolved in the state or federal courts of Delaware, and you consent to personal jurisdiction there.
14.6 Small Claims Court Exception
Either party may bring an individual claim in small claims court (without arbitration) for disputes within that court's jurisdiction.
14.7 Injunctive Relief Exception
Either party may seek injunctive or equitable relief in a court of competent jurisdiction to protect intellectual property or confidential information, without first going through arbitration.
15. General Provisions
- Entire Agreement: These Terms and the Privacy Policy are the entire agreement between you and amingo
- Severability: If any provision is unenforceable, the rest remains in full force
- No Waiver: Our failure to enforce any provision is not a waiver of our rights
- Assignment: You may not assign your rights. amingo may assign its rights in connection with a merger, acquisition, or sale of assets — we will notify you if this affects your data
- Language: These Terms are in English. Translations are for convenience; the English version controls
- Updates: We will notify you at least 30 days before material changes take effect via in-app notification or email

17. Apple App Store — Required Disclosures
This section is required by Apple and applies to users who download amingo via the Apple App Store.
- These Terms are an agreement between you and amingo only — Apple is not a party to these Terms
- Apple has no obligation to provide maintenance, support, warranty, or technical assistance for amingo
- If amingo fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). Apple has no other warranty obligation with respect to amingo
- Apple is not responsible for addressing any claims relating to amingo or your use of it, including product liability claims, consumer protection claims, or intellectual property infringement claims
- If any third party claims that amingo infringes their intellectual property rights, Apple is not responsible for investigating, defending, or settling such a claim
- Apple and Apple's subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple has the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary
- You represent and warrant that you are not located in a country subject to US government embargo or designated as a terrorist-supporting country, and you are not on any US government prohibited or restricted party list
18. Section 230 Notice
amingo is an interactive computer service provider. We are not the publisher or speaker of third-party User Content, including Mini Me outputs that are derived from user-provided inputs. We are not liable for User Content under 47 U.S.C. § 230 except as provided by applicable federal law.
